Our Services

Our Services

We offer legal services for all aspects of surrogacy agreements and post-birth legal work in Hawaii. We work with surrogacy agencies to help define the scope of the relationship between intended (prospective) parents and their designated surrogate. We also work with couples who are not working with a surrogacy agency and who have already located their designated surrogate.

Each case will be properly screened to ensure representation is conflict-free and to confirm Hawaii jurisdiction is appropriate for your journey.

FCH provides the following legal services:

Gestational Carrier Agreements

The Gestational Carrier Agreement is the all-encompassing contract between the Intended Parents and the Gestational Carrier. It defines the rights and responsibilities of the parties involved, spells out what will occur before, during, and after the birth, and plans for unexpected situations during the pregnancy. We are able to represent either side, the Intended Parents or the Gestational Carriers, while negotiating a Gestational Carrier Agreement.

Parentage Proceedings

Depending on your particular surrogacy match, the type of court cases that are filed may differ. Hawaii is a “post-birth” state, meaning, legal parentage of a child must be established after the child is born. The timeline for completion of the parentage proceedings can range from 1-3 months after birth (for births on the “outer” islands of Hawaii, Maui, or Kauai), or 4-6 months after birth (for births on the island of Oahu). We pride our practice on preparation and prefer to be as prepared as possible by the time of birth. This practice ensures that legal proceedings are commenced as soon as possible after birth. Upon successful completion of your parentage proceedings in Hawaii’s family court system, a new Hawaii birth certificate will be issued with the names of the Intended Parent(s) on it.
