We offer legal services for surrogacy in Hawai'i that covers all aspects of surrogacy agreements and post-birth legal work in this state. Gestational Carrier Agreements
The Gestational Carrier Agreement is the all-encompassing contract between the Intended Parents and the Gestational Carrier. It defines the rights and responsibilities of the parties involved, spells out what will occur before, during, and after the birth, and plans for unexpected situations during the pregnancy. We are able to represent either side, the Intended Parents or the Gestational Carriers, while negotiating a Gestational Carrier Agreement.
Egg/Sperm Donor Agreements
Drafting, negotiation, and finalization of sperm donation and egg donation agreements from an anonymous donor or a known donor.
Parentage Proceedings
Depending on your particular surrogacy match, the type of court cases that are filed may differ. Hawaii is a “post-birth” state, meaning, legal parentage of a child must be established after the child is born. The timeline for completion of the parentage proceedings can range from 1-3 months after birth (for births on the “outer” islands of Hawaii, Maui, or Kauai), or 4-6 months after birth (for births on the island of Oahu). We pride our practice on preparation and prefer to be as prepared as possible by the time of birth. This practice ensures that legal proceedings are commenced as soon as possible after birth. Upon successful completion of your parentage proceedings in Hawaii’s family court system, a new Hawaii birth certificate will be issued with the names of the Intended Parent(s) on it.
For Foreign Intended Parents
We are also able to provide specialized assistance with establishing legal parentage in your home country. We will work with your attorney in your home country to ensure the process goes as smoothly as possible so you can return home with your child as soon as possible after birth.
